US Court Mandates Release of Kilmar Abrego Garcia from ICE Custody
A court has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment is without legal authority.
"Since his release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.
The situation originates in a erroneous removal to El Salvador in March, which US authorities later admitted was an error. After his repatriation to the United States to answer alien smuggling allegations, he was detained in immigration detention.
In her decision, the court pointed out that the government lacks a current deportation order, which prevents them from removing Mr. Abrego Garcia "for now."
